The terms governing your use of the STAYN platform and services.

1. Acceptance of Terms
By accessing or using STAYN's platform, website, or services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services. We reserve the right to update these terms at any time, and continued use constitutes acceptance of the updated terms.
2. Definitions
"Platform" refers to STAYN's website, mobile application, and related services. "Owner" means a person listing a property on STAYN. "Tenant" means a person searching for or renting a property through STAYN. "Move Pass" refers to our membership program. "Agreement" refers to the rental agreement executed between Owner and Tenant through our platform.
3. Account Registration
Users must register an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must provide accurate, current, and complete information. STAYN reserves the right to suspend or terminate accounts that violate these terms.
4. Property Listings
Owners represent and warrant that all property information provided is accurate and complete. STAYN verifies properties to the best of its ability but does not guarantee the accuracy of listings. STAYN reserves the right to remove listings that are misleading, inappropriate, or violate our policies.
5. Tenant Screening & Visits
STAYN facilitates property visits and tenant screening. We conduct background checks and verification as part of our process but do not guarantee tenant suitability. Owners retain the final decision on tenant selection. Visit requests are subject to availability and scheduling.
6. Move Pass Membership
Move Pass is an annual membership that provides access to verified properties, dedicated support, and other benefits. Membership fees are non-refundable except as explicitly stated in the Move Pass terms. STAYN reserves the right to modify Move Pass benefits with reasonable notice.
7. Fees & Payments
STAYN charges service fees as disclosed during the booking or listing process. All fees are in Indian Rupees (INR) inclusive of applicable taxes. Payments are processed through Cashfree, a third-party payment gateway. STAYN does not store your payment information.
8. Rental Agreements
STAYN facilitates the execution of rental agreements between Owners and Tenants. The agreement is a legally binding contract between the Owner and Tenant. STAYN is not a party to the rental agreement and bears no liability for disputes arising from it.
9. Cancellation & Refunds
Move Pass membership fees are non-refundable. Property booking cancellations may be subject to fees as outlined during the booking process.
10. Limitation of Liability
STAYN is a managed rental operations platform and is not a party to rental agreements between Owners and Tenants. To the fullest extent permitted by law, STAYN's liability is limited to the fees paid for the specific service giving rise to the claim. STAYN is not liable for indirect, incidental, or consequential damages.
11. Intellectual Property
All content on the STAYN platform, including logos, text, graphics, and software, is the property of STAYN or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.
12. Prohibited Conduct
Users may not misuse the platform for fraudulent activities, spamming, harassment, or any illegal purpose. Circumventing STAYN's fee structure, manipulating listings, or interfering with other users' experience is strictly prohibited.
13. Termination
STAYN may suspend or terminate access to the platform at any time for violation of these terms. Upon termination, your right to use the platform ceases immediately. Sections related to liability, intellectual property, and dispute resolution survive termination.
14. Governing Law & Dispute Resolution
These terms are governed by the laws of India. Any disputes arising out of these terms shall first be attempted to be resolved through amicable negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the Hon'ble Punjab and Haryana High Court.
